BIOGRAPHY:
Bennett J. Wasserman focuses his practice in the areas of professional liability, professional responsibility and fiduciary duties of the legal profession and of the financial and securities industries. He has been deeply involved in the prosecution, defense and resolution of complex claims in these areas. He also serves as strategic consultant and expert witness to lawyers, law firms and professional liability insurers in legal malpractice litigation. He is frequently called upon to analyze complex issues of compliance or departures from standards of legal practice and rules of professional conduct and has been recognized as an expert in those areas by state and federal courts. Several reported court decisions have cited his work as the basis for their decisions. In one reported decision, Mr. Wasserman was co-lead counsel for Super Lawyers, wherein he successfully argued that the lawyer advertising rules of the New Jersey Supreme Court violated constitutionally protected free speech guarantees. As a result, those Rules have been re-written.
Since 1990, Mr. Wasserman has served as Special Professor of Law at Hofstra University School of Law where he teaches a full semester course in Lawyer Malpractice. He has also been a guest lecturer at other law schools at home and abroad and has served on the faculty of continuing legal education programs. He is a regular contributor to legal publications and is the co-author of the New Jersey Law Journal's Annual Review of the New Jersey Supreme Court's decisions in the areas of legal ethics and malpractice.
Mr. Wasserman is a graduate of Hunter College (B.A. 1968, M.A. 1971) and of Hofstra University School of Law (J.D. cum laude, 1974 A) where he served as Articles Editor of the Hofstra Law Review. He is admitted to practice in the States of New Jersey, New York and Pennsylvania and in the United States District Courts, Circuit Courts of Appealand the United States Supreme Court. Mr. Wasserman has been Certified as a Civil Trial Attorney by the Supreme Courts of New Jersey since 1985.
Mr. Wasserman has been elected among New Jersey's Super Lawyers (Professional Liability), Best Lawyers in America (Legal Ethics and Legal Malpractice), and has been listed in the Bar Register of Pre-eminent Lawyers with an AV rating from Martindale-Hubble. In 2008, the New Jersey Law Journal voted him as a "Lawyer of the Year".
